Customer End-User Service Agreement

This End-User Service Agreement (“EUSA”) is a legal agreement between (a) (“CUSTOMER” either an individual or a single entity or Company) and (b)Booksadvisors.com (Penn Valley, PA-19072 USA) (“MERCHANT”) that is made on . By signing this agreement, you agree to the understanding shown below and agree to be bound by the terms of this EUSA.

(a) Capacity and Authority to contract: CUSTOMER represents that you are of legal age of majority in your state of residence and, if applicable you are duly authorized to enter into this contract.

(b) Description of services: MERCHANT is engaged in the business of Accounting Service, Bookkeeping Service, Software Sales, Books Cleanup Service, Company File Setup & Review, Data Conversion, Payroll Issue, Reconciliation Service, Setup & Installation.

(c) Term: This EUSA is effective unless terminated and is valid for the period of 30 days from the date of establishment.

(d) Payment: Payment shall be made to BooksAdvisors.com (Penn Valley, PA-19072). The charge on CUSTOMER statement will appear as Books Advisors / QBO Advisor / QB Service / QB Services /BooksAdvisors.

(e) Independent Service Company: MERCHANT is an independent accounting solutions provider firm and does not represent to be affiliated with any other software firm.

(f) Limited Liability: The parties understand and agree that MERCHANT and its employees, subcontractors, and its agents assume no Liability or responsibility for the cost of repairing or replacing any equipment, software or personal property, including intellectual property lost or damaged, either current or arising in the future, or any consequential damage of any nature incurred as a result of the services rendered to the CUSTOMER. The CUSTOMER agrees that in the event the CUSTOMER incurs any loss as a result of the services rendered it pursuant to this agreement, the MERCHANT, its employees, subcontractors, and agents is liable only to the extent of the MERCHANT charge to this CUSTOMER for this Agreement.

(g) Right to refuse, suspend or terminate service: MERCHANT reserves the right to refuse, suspend or terminate service to any user for any reasons related to the improper / illegal use of computers in the service plan. In the event of such refusal or termination, a refund for time remaining will be made and will be credited to CUSTOMER account within 7-10 working days of termination.

(h) Transfer: This agreement is nontransferable without the prior agreement of MERCHANT. The new end user receiving the transferred agreement must agree to all the EUSA terms.

(i) Privacy Policy: The BooksAdvisors.com Privacy Policy is an integral part of Terms and Conditions. If you have not yet reviewed the Privacy Policy, then please do so prior agreeing to these Terms and Conditions. You agree that beyond the Personal Information identified in the Privacy Policy, any information or data disclosed or sent to BooksAdvisors.com over the telephone, electronically or otherwise, is not confidential or proprietary to you. Once the job is complete your data will be deleted from our server and we will not able to provide the copy of it in future.

(j) Refunds Policy: For any service done on an account if the customer would like a refund within 30 days from the purchase, FULL REFUND will be given regardless of what the issue might be at any time after service is done. For any software purchased the customer will have the option to either get a full refund and have the QB license removed from the system or opt to keep the software and no refund will be given for the first 60 days after purchase. All financial software purchased through BooksAdvisors.com may be returned within 60 days from the date of invoice or as per application refund policy in force at the time of subscription. Entire Agreement

This EUSA is the entire agreement between the CUSTOMER and MERCHANT and it supersedes all prior or oral or written communications, proposals and representations with respect to service covered by this EUSA.
